Terms and Conditions
This translation is provided for convenience. The Spanish version prevails.
1. Purpose and Acceptance
These terms govern the use of the website https://casa53baq.com, operated by GRAN INVERSIONES C & M S.A.S. (NIT 902.014.927-5). Space bookings are intended exclusively for adults. When making a booking, you must accept these terms by expressly ticking the (unticked) boxes provided for that purpose:
- I have read and accept the Terms and Conditions.
- I authorize the processing of my personal data in accordance with the Personal Data Processing Policy.
- I authorize the sending of commercial and advertising communications.
The system will keep a technical record (date, time and version) of your acceptance.
2. Bookings and Services
The site allows you to browse and request space bookings. A booking request made through the website is not a final confirmation until Casa 53 verifies and confirms the availability of the space. Each confirmation will detail the included services (capacity, internet, furniture) and the total price.
3. Prices and Information
Prices, features, schedules and conditions of the spaces will be clearly provided through the corresponding channels. Where there is a difference between published information and a booking confirmation, Casa 53 will review the situation and apply the applicable consumer protection rules.
4. House Rules and Guests
At Casa 53 we promote a calm working environment (e.g. use of headphones and moderate volume in common areas).
- The client (booking holder): By booking, you agree to follow our house rules.
- Your guests: As a client, you undertake to inform your guests of these rules. On arrival, your visitors must register and receive information about the entry, security, house rules and personal data processing applicable to their visit.
5. Personal Belongings
Casa 53 is not a safekeeping service. We recommend not leaving belongings unattended. Casa 53 is not responsible for loss, damage or theft of personal belongings unless it is proven that the incident was caused by the proven fault of Casa 53 or its staff.
6. Liability for Damages
You are responsible for damage caused to the premises or furniture, provided it is objectively proven that it was caused by you or your guests. In that case, the charge will be based on the reasonable and demonstrable cost of repair or replacement, and you will have the right to dispute it.
7. Cancellations, Withdrawal and E-commerce
- Cancellations and no-shows: You may cancel or reschedule your booking free of charge by notifying us at least twenty-four (24) hours before the scheduled time. Cancellations with less notice, or no-shows without prior notice, may result in a charge of 100% of the booked space's fee or restrictions on future bookings.
- Future payments and withdrawal: When electronic payment methods are enabled on our platform, the applicable e-commerce and consumer protection rules will apply. Where legally applicable, the consumer may exercise the right of withdrawal within five (5) business days of entering into the contract, under Law 1480 of 2011 and its amendments. In e-commerce cases, refunds will be made within the applicable legal period of a maximum of fifteen (15) calendar days.
8. Requests, Complaints and Claims
To submit requests or complaints about the service, write to front@casa53baq.com. On receiving your email, Casa 53 will assign and send you a case number to facilitate formal follow-up.
9. Intellectual Property
Trademarks, logos, texts, photographs and the site design belong to Casa 53 or are legitimately used by it under license. Unauthorized reproduction is prohibited.
10. Limitation of Liability and Force Majeure
Casa 53 will not be liable for delays or failures caused by force majeure events. The Wi-Fi service may experience interruptions inherent to the telecommunications provider, and you agree not to use it for unlawful purposes. This is without prejudice to liabilities that cannot legally be excluded or limited against the consumer.
11. Changes and Governing Law
Any change to these terms will apply only going forward and will be published on this site. Disputes will be governed by the laws of the Republic of Colombia, and the competent authority for consumer protection is the Superintendence of Industry and Commerce (www.sic.gov.co).
